These terms govern cloud hosting, hosted servers, virtual infrastructure, storage and related hosting services provided by Technology Mechanics. A signed agreement, quote or order controls if it provides different terms.
Service Scope
The order identifies the hosted resources, management level, storage, licensing, backup, support and other included services. Features not listed in the order are not included by default.
Customer Content and Use
The customer retains responsibility for the legality, accuracy and authorized use of content placed in the hosted environment and must comply with our Acceptable Use Policy.
Security and Administration
Responsibilities for operating-system administration, patching, application security, identity, firewalling and monitoring depend on whether the service is managed or unmanaged. The customer remains responsible for functions that are not expressly included in Technology Mechanics' scope.
Backup
Backup is not included unless stated in the order. Where backup is purchased, the applicable backup configuration, retention and recovery terms control. Customers should not treat snapshots or redundant storage as a substitute for a defined backup service.
Maintenance and Availability
We may perform scheduled or emergency maintenance to protect or maintain the service. Eligible hosted services may be covered by the Technology Mechanics Uptime Guarantee.
Fees, Suspension and Termination
Recurring hosting fees are billed according to the order. We may suspend or restrict service for nonpayment, unlawful activity, material security risk or violations of the Acceptable Use Policy when reasonably necessary. Customers should export needed data before termination. Data may be deleted after termination in accordance with the service configuration and backup lifecycle.
Third-Party Infrastructure
Hosting may depend on data-center, carrier, cloud, software or licensing providers. Their outages, restrictions and license terms may affect the service.
Governing Law
Unless a signed agreement states otherwise, these terms are governed by Nevada law, with venue in Clark County, Nevada, except where applicable law requires otherwise.
