These terms apply to Technology Mechanics managed backup and recovery services, including services marketed as TMBackup. A signed agreement, quote or order controls specific systems, capacity, retention and pricing.
Protected Data
The customer is responsible for identifying the systems and data to be protected and for notifying Technology Mechanics when systems, applications or data locations change. Data that is not included in the configured backup scope is not protected by the service.
Backup Configuration and Retention
Backup frequency, local or off-site copies, storage capacity and retention are defined by the applicable configuration or order. Retention is not indefinite unless expressly stated.
Monitoring
For managed backup services, Technology Mechanics monitors backup status and responds to failed or incomplete jobs within the scope of the service. Monitoring cannot guarantee that every file, application or recovery point will be usable in every circumstance.
Recovery
Recovery is performed from available, usable recovery points. Recovery time depends on data volume, connectivity, hardware, application requirements, the condition of the source systems and the nature of the incident. Unless expressly stated in a signed agreement, no specific recovery-time or recovery-point objective is guaranteed.
Customer Responsibilities
The customer must maintain appropriate access, licensing and connectivity, promptly report material environment changes and cooperate with recovery testing or remediation recommendations.
Security and Encryption
Backup data is handled using the security controls provided by the configured backup and storage platforms. Customers must not assume a backup is immutable, air-gapped or subject to a particular retention lock unless that feature is specifically included and documented.
Billing and Termination
Backup fees are billed according to the applicable order and may vary with protected devices, capacity, storage or licensing. Upon termination, the customer should arrange any required data export or restoration before backup data is removed through normal service and retention processes.
No Substitute for Business Continuity Planning
Backup is one component of business continuity. Customers should maintain appropriate recovery plans, alternate systems and operational procedures based on their business requirements.
Governing Law
Unless a signed agreement states otherwise, these terms are governed by Nevada law, with venue in Clark County, Nevada, except where applicable law requires otherwise.
